Experiences by Nickelodeon Privacy Policy for Kids and Parents

Welcome! This Privacy Policy describes the privacy practices of the Nickelodeon family of brands, which is a programming service under Viacom International Inc. (such programming services collectively “Nickelodeon”, “we”, “us”, or “our”). It applies when you or your child visit the Experiences by Nickelodeon website, any other website mobile application, or online service where this policy is posted and which is operated by Nickelodeon in connection with any Nickelodeon Experience (such as a Nickelodeon theme park, live show or festival, entertainment center, hotel & resort, or museum exhibit),  or attend a Nickelodeon Experience. This Privacy Policy collectively refers to these touchpoints as “Services.” We explain here what personal information Nickelodeon collects about you or your child when using the Services, how we use, store, and share that information, and your rights and choices concerning that information.

Some of our Services are designed for children or may allow us to collect information from children. This policy is in accordance with the U.S. Children’s Online Privacy Protection Act (also known as “COPPA”), among other applicable privacy laws, and outlines our practices in the United States and globally regarding children’s information collected from users of the Services. For our practices with respect to these Services or data collected from children, see the Children’s Privacy section.

We will change this Privacy Policy from time to time. When we make changes, we will revise the date at the top of the policy and, in some cases, will notify you through the Services, such as via the Experiences by Nickelodeon website, email, or other communication.

Personal Information We Collect

Information You or Your Child Actively Provide

You or your child can use some of our Services without actively submitting any information about yourself, but the Services allow you to provide personal information to us in some circumstances. For example:

  • Identifiers, such as name, username, email address, phone number, and mailing address.
  • Other information you choose to provide, such as information you provide to participate in our contests, promotions, or market research surveys.
  • If you choose to post content or communicate with us or others on a public platform we host or through user support, we will collect the information you provide in those postings.

Information Collected Automatically

When you or your child access our Services, our servers automatically collect Internet and other electronic network activity, information about the use of the Services, such as access times and pages viewed on the Experiences by Nickelodeon website. We also receive and collect information about your or your child’s device, software, and network identifiers, including hardware model, operating system and version, unique device identifiers, browser and version, mobile network information, ISP, proxy server, IP address, and the page visited before visiting our website.

Information Collected at Nickelodeon Experiences

When you or your child attend an in-person Nickelodeon Experience (such as SlimeFest, the Nickelodeon Universe theme park, a Nickelodeon exhibit at a children’s museum, or Nickelodeon hotel and resort), we or our partners may collect information about you, or with your permission, your child’s participation, such as your first and last name, your email address or other contact information, whether you purchased a ticket or other merchandise at the event, which members of your family, if any, are accompanying you, and their ages.  We may also collect photos or video of you at interactive attractions such as photo booths or augmented reality experiences. To the extent one of our partners collects your or your child’s personal information at a Nickelodeon Experience, that collection of personal information is pursuant to that partner’s privacy policy, and we encourage you to review that privacy policy before providing your information to them.

Information from Third Parties

We may also collect your personal information from third parties. For example, we may obtain personal information from in-person event producers or similar partners to facilitate your use of the Services or participation at a Nickelodeon Experience. We may also collect information from third parties for marketing purposes, such as email lists.  In some instances, we may combine data we collect about you with data we have collected from third parties to allow us to better understand your interests and to provide you with more tailored marketing.

Personal Information We Derive

We may derive information or draw inferences about you or your child based on the information we or our partners collect. For example, we may make inferences about your location (e.g., country, state, and city) based on your IP address.

Please note that all of the information we collect about you may be combined and used for the purposes described in the “How We Use Personal Information” section.

Social Sharing

The Services may give you the option to share with others on social media platforms, such as Instagram, Facebook or Twitter. When you share in this manner, the privacy practices of the social media platform control who has access to your information and how it is treated by the social media platform. Please consult the privacy policies of any social media platform to which you share information in this manner to learn about the social media platform’s data practices. Note that children may not use these features.

How We Use Personal Information

We use the personal information we collect for the purpose for which we collected it, such as to facilitate your discovery and participation in a Nickelodeon Experience, send promotional messages or other information you request, or facilitate contests and other promotions.

We also use the information we collect to verify parental consent, provide, maintain, and improve our Services, and to develop new features that we hope you, or in some cases your child, will enjoy. This includes analyzing traffic and user activities on our Services, identifying popular areas or features, and optimizing and personalizing the Services. Finally, we use the information we collect to protect the rights and property of Nickelodeon and others, including to detect, investigate, and prevent fraud and other illegal activities and to enforce our agreements.

How We Might Disclose Personal Information

Nickelodeon does not sell personal information collected from children or teens we know to be under 16. We only share the personal information we collect in the limited circumstances described below:

  • With our Affiliates and Subsidiaries. We disclose personal information to other Nickelodeon or related companies, our parent company, and its subsidiaries and affiliates, for the purposes described in the “How We Use Personal Information” section above.
  • With our Service Providers. We share personal information with unaffiliated companies or individuals we hire or work with that perform services on our behalf, including customer support, payment processors, or others who assist us in fulfilling orders or transactions, web hosting, information technology, and analytics services.
  • In Connection with a Corporate Transaction. Personal information may be disclosed or transferred as part of, or during negotiations for, any purchase, sale, lease, merger, or any other type of acquisition, disposal, or financing involving Nickelodeon, its parent entities, or related brands.
  • With our Professional Advisors. We share personal information with our legal, financial, insurance and other advisors in connection with the corporate transactions described above or in connection with the management of our business and operations.
  • With Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We share personal information when it is necessary for us to comply with applicable law or legal process, to respond to legal claims, or to protect the rights, property or personal safety of Nickelodeon, our users, employees, or the public.
  • With our Partners. We may share your information with our Partners as necessary to facilitate your or your child’s participation in Nickelodeon Experience in-person events.
  • With Social Media Platforms. We share personal information with social media platforms so we can better reach you and for marketing purposes if you have an account with that social media platform.
  • With Your Consent or At Your Direction. We share personal information with third parties when you or your child, if they are between 13-16, ask us to do so.

Advertising Services Provided by Others

Cookies and Similar Technologies

We and our advertising and analytics service providers use cookies, which are small text files that help store user preferences and activity, similar technologies such as web beacons, pixels, ad tags, and SDKs, which are blocks of code provided by our partners that may be installed in our mobile and online applications, to recognize you when you visit our Services, and to collect information such as the number of visits, which features, pages, or content are popular, and to measure your browsing activities.  These technologies allow us to optimize the operation of our Services, including by allowing us to help ensure our Services are functioning properly, improve the Services, and to provide and measure contextual advertisements. On any of our Services or portion of the Services that is directed to children, we do not use, or allow our partners to use, automatically collected information, such as IP addresses, cookie identifiers, and other device identifiers, other than for purposes of supporting our internal operations, such as to provide children with access to features and activities on the Services, to customize content and improve our Services, and to serve contextual advertising and limit the number of times you or your child see a particular advertisement. We do not allow online behavioral advertising, sometimes called personalized advertising or tailored advertising to children or teens under 16. 

For the portions of our Services that are directed to audiences older than 16, we may share identifiers such as cookies and the advertising identifier associated with your mobile device with our advertising partners, and those partners may use and share those identifiers to show ads that are targeted to your interests.

For information on how our advertising partners allow you to opt out of receiving ads based on your web browsing history, please visit www.aboutads.info or visit our Cookie Policy. Your device may also include a feature that allows you to opt out of the use of information about your use of mobile apps for interest-based advertising purposes (“Limit Ad Tracking” on iOS devices or “Opt Out of Personalized Ads” on Android devices). 

Websites and Data Collection of Third Parties

The Services may include links to other websites or services, such as to purchase tickets to a Nickelodeon Experience, or purchase of a consumer or virtual good or service. Personal information collected on other sites and services is subject to the privacy policy and practices of the third party providing such website or service and not this Privacy Policy. 

Similarly, on the Services or portions of the Services that are not directed to children, we may give you the option to share with others on social media platforms, such as Instagram, Facebook or Twitter. When you share in this manner, the privacy practices of the social media platform control who has access to your information and how it is treated by the social media platform. 

Please consult the privacy policies of any social media services or other third parties with which you share information in this manner to learn about the social media platform’s data practices. 

Data Storage

We store the personal information we collect for as long as is necessary for the purpose(s) for which we originally collected it. For example, if you register for an account with us, we will generally maintain account information as long as needed to service the account. We may also retain personal information as required by law.

Categories of Information We Collect, Use, and Disclose for Business Purposes

We collect the following categories of personal information as described in the Personal Information We Collect section. We collect this information from you, your child, third parties, or as otherwise described in this policy. We use these categories of information as described in the Use of Your Personal Information section above, and we disclose these categories of personal information for business purposes as described above and in the Disclosure of Your Personal Information section:

  • Identifiers such as name, email address, phone number, postal address, and IP address.
  • Internet or other electronic network activity information, such as log data, and information about the device and computers you use to access the Services.
  • Demographic information, such as gender and age;
  • Commercial information, such as records of purchases and payment information;
  • Other information you provide, such as messages on discussion boards or responses to surveys;
  • Inferences drawn from any of the above, including location drawn from IP address.

Your Rights

Under the California Consumer Privacy Act (CCPA), California residents have the right to request access to or deletion of their personal information, to request additional details about our information practices, and to not be discriminated against for exercising their rights. You may exercise your right to access or delete information we have collected about you or your child by visiting the CCPA Access Page or calling us at 888-851-8412. Note that even if we honor your request to delete your information, we may retain certain information as required or permitted by law.

We do not sell personal information collected by or from any Service or portion of a Service that is directed to children or where we know that the user is a child or a teen under 16. For the portions of our Services that are directed to audiences older than 16, we do not sell identifying information such as name, email address, phone number, or postal address, but we may share identifiers such as cookies and the advertising identifier associated with your mobile device with our advertising partners, and those partners may use and share those identifiers to show ads that are targeted to your interests. If this takes place, these disclosures may constitute a “sale” under California law. Where we engage in this type of disclosure, we give you the option to opt out of disclosures for these purposes at any time by following the “Do Not Sell My Personal Information” link on the homepage or download page of the relevant website, mobile app, or other service. 

International Data Transfers

We operate globally and we may transfer your personal information to, or store or access it in, the United States and other countries. Where the laws of your country allow you to do so, you authorize us to transfer, store, and use your and your child’s personal information in the United States and any other countries where we or our service providers operate.

When we transfer your data from the EEA or Switzerland to the United States, we take steps to ensure that your personal information receives an appropriate level of protection through contractual requirements imposed on the recipient of the information (you can obtain a copy of these clauses by contacting us).

Legal Basis for Processing for EEA Visitors

We will only process your or your child’s personal information in the following situations:

  • When we have your consent to do so. For example, if you opt-in to receive promotional emails. You can withdraw your consent at any time as described below.
  • We need to use personal information to perform our responsibilities under our contract with you (for example, providing the products or services you or your child have requested).
  • We have a legitimate interest in processing personal information. For example, we may process your personal information to communicate with you about changes to our Services, and to provide, secure, and improve our Services.
  • We are required by law to process the information.

Your Rights and Choices

Where the laws of your country provide (such countries in the EEA), you have the right to access the personal information we hold about you or your child and to ask us to correct, erase, or, in some situations, transfer personal information to another provider, subject to certain exceptions. In certain circumstances, you also have the right to object to, or request that we limit or restrict, certain processing as described below. You can also withdraw your consent to processing personal information. 

If you are a parent or guardian, you can exercise these rights on behalf of your child as discussed below in the Children’s Privacy section.

Access and Deletion Requests

On those services where account creation and registration are available, you can update or correct your registration information by logging in to your account and adjusting your settings. You may also update, correct, or delete information we have about you or close your account by contacting us.

Email and SMS Messages

You may opt out of receiving promotional emails, text or SMS messages by following the instructions in those messages or by contacting us. If you opt out of receiving promotional emails from us, we will still send you non-promotional emails, such as messages about an upcoming visit to a show or live event, or when you have requested a response from us.

Location Data

When you use any of our mobile apps that collect precise location information, you may be asked to consent to the collection of this information. You can change your preferences at any time through the settings on your mobile device.  We do not collect precise location information from children.

Mobile Push Notifications/Alerts and Local Notifications

With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.

We do not send push notifications to children, but we may use “local notifications” that are sent directly through a mobile app to your or your child’s device (and do not require an internet connection).  We may use these local notifications to notify you or your child of new content or events within the app, among other reasons.

If you have a question about our Privacy Policy, data practices, or the choices available to you, please contact us. If we are not able to address your concern and you are a resident of the EEA, you have the right to lodge a complaint with the Data Protection Authority where you reside. Children’s Privacy

We recognize the need to provide further privacy protections when it comes to children. Some of the Services are directed at children, while other Services or portions of them are intended for use by adults. For Services that are directed to children or that allow children (as defined by the law in a particular location, for example under 13 in the United States, and under 16 in some countries in the European Union) to submit personal information, we will collect, use, and disclose personal information as described in this privacy policy, with certain differences and specific practices as described below. 

Collection of Information from Children

When a user informs us that they are a child as defined in your jurisdiction, they will be directed to an experience intended for children. We do not allow users who are identified as children to provide their names, email addresses, or other identifying information or to use social media sharing or log-in functions. On portions of our Services directed to children, we also do not use, or allow our partners to use, automatically collected information, such as IP addresses, cookie identifiers, and other device identifiers, other than  for purposes of supporting our internal operations, such as to provide children with access to features and activities on the Services and to customize content and improve our Services and Nick Experiences. We never allow interest-based advertising on portions of our Services that are directed to children.

At some Nickelodeon Experiences, we or our partners may offer attractions that capture photo or video of a child, such as a photo booth or augmented reality experience.  We do not permit children to access these attractions without the supervision of a parent or guardian. We will also not use the photo or video of the child for any purpose other than to provide the experience, or to send the photo or video to a parent or guardian if the parent or guardian provides their email address.  We do not request email addresses from children on the Services. 

At any time, you can refuse to permit us to collect personal information from your child, and can request that we delete from our records the personal information we have collected. If you have any questions or concerns about our approach to children’s privacy, you want to access the data of your child, or request the deletion of your child’s data, please contact us.

Websites and Data Collection of Third Parties

Our Services may include links to other websites or services, such as to purchase tickets to a Nickelodeon Experience. Personal information collected on other sites and services are subject to the privacy policy and practices of the third party providing such website or service and not this Privacy Policy. We encourage you to review the privacy policy of such third party before providing personal information to them.
